1. Scope of Agreement & Acceptance
Welcome to BoleVyapar (“BoleVyapar”, “we”, “our”, or “us”). By accessing our website, purchasing or displaying our physical QR standee collateral, or scanning a BoleVyapar-enabled campaign at a local business, you agree to be bound by these Terms of Service.
These Terms apply jointly to:
- Merchants / Store Operators: Commercial enterprises (such as retail showrooms, dining cafes, wellness salons, healthcare clinics, and workshops) that provision and place BoleVyapar standees on their premises.
- Customers / Consumers: Individual walk-in shoppers and patrons who scan a standee to articulate feedback and navigate to third-party review platforms.
2. The Core Assistive Review Principle
BoleVyapar provides assistive articulation software designed to overcome writer’s block and language barriers for retail shoppers. To maintain unyielding consumer trust and regulatory compliance, the following standards are non-negotiable:
3. Merchant Code of Conduct & Anti-Gating Policy
Every merchant provisioned on the BoleVyapar network agrees to adhere strictly to the following ethical rules. Violations will result in immediate standee deactivation without refund:
Merchants shall never attempt to filter, screen, or divert customers based on their sentiment. All customers—whether expressing delight, mixed feelings, or service criticism—receive direct and equal access to the merchant’s public Google review page. Private feedback is strictly an optional convenience channel and must never be used to gate public reviews.
- Place standees visibly at customer billing counters and handover desks.
- Neutrally invite patrons to scan if they wish to share feedback.
- Celebrate genuine customer feedback and use it to improve store service.
- Never offer discounts, freebies, gifts, or incentives in exchange for reviews.
- Never require a review as a condition for billing or product delivery.
- Never pressure customers or stand over their shoulders during drafting.
- Never ask store staff or relatives to generate fabricated reviews.
4. Physical Standees, Validity & Renewals
BoleVyapar operates on a zero-dashboard physical collateral model. Physical standees (A6 cast acrylic table tents, A5 counter cards, and vinyl POS decals) are manufactured and dispatched to the merchant’s verified commercial location upon activation.
- Subscription Validity: Standees remain active for the duration agreed upon during provisioning (e.g., 1 month, 3 months, 6 months, 1 year, or lifetime).
- Expiry Enforcement: When a campaign reaches its expiration date, QR scans will immediately cease customer session generation and display a neutral expiration notice with direct renewal options.
- Renewals: Merchants can renew their standee campaigns directly via our authorized WhatsApp Concierge (+91 8200177315) without needing to replace their physical acrylic hardware.
- Care & Maintenance: Merchants are responsible for keeping physical standees clean and unobstructed on their billing counters.
5. Third-Party Independence & Trademark Disclaimers
Disclaimer of Google Affiliation: BoleVyapar is an independent SaaS provider. BoleVyapar is not affiliated with, authorized by, sponsored by, or endorsed by Google LLC or Alphabet Inc. Google, Google Maps, and Google Business Profile are registered trademarks of Google LLC. BoleVyapar facilitates customer navigation to publicly accessible web URLs configured by merchants.
BoleVyapar does not govern Google’s internal ranking algorithms, content moderation policies, account verification procedures, or review visibility filters. We cannot and do not guarantee that any customer review will be published or retained by Google Maps.
6. Intellectual Property & Content Rights
BoleVyapar Property: The BoleVyapar brand name, logo, graphic designs, acrylic layout templates, and software code are the proprietary intellectual property of BoleVyapar.
Merchant Marks: Merchants grant BoleVyapar a limited license to display and render their trade names and registered logos solely for the purpose of crafting personalized business acrylic stands and public QR landing headers.
Customer Generated Text: Customers retain full ownership and moral rights over any reviews they ultimately author and post to Google Maps. BoleVyapar claims zero copyright over customer review text.
7. Limitation of Liability & Disclaimers
To the fullest extent permitted by applicable Indian law:
- BoleVyapar collateral and services are provided on an “AS IS” and “AS AVAILABLE” basis without warranties of any kind.
- We do not guarantee increased revenue, footfall, star ratings, or business volume.
- In no event shall BoleVyapar be liable for any indirect, consequential, punitive, or incidental damages arising out of merchant operations or third-party platform actions.
- Our total aggregate liability for any claims under these Terms shall not exceed the subscription fees actually paid by the merchant in the preceding three (3) months.
8. Governing Law & Grievance Redressal
These Terms shall be governed by and construed in accordance with the laws of the Republic of India. The courts situated in Gujarat, India, shall have exclusive territorial jurisdiction over any disputes arising hereunder.
